Broadcom accuses Qualcomm of infringing its patents

US communications chip maker Broadcom has started federal litigation against Qualcomm, alleging that its US rival has infringed ten of its patents related to communications and multimedia processing technologies.

In two complaints filed in the Central California District Court, Broadcom is seeking unspecified monetary damages from Qualcomm as well as a permanent injunction barring the manufacture and sale of Qualcomm's core suite of baseband and RF integrated circuits, including its voice-over-internet-protocol chips for cellular phones. Broadcom alleges these products infringe its patents.

The company has also filed a complaint with the United States International Trade Commission (ITC), accusing Qualcomm of engaging in unfair trade practices by importing integrated circuits and other products that allegedly infringe five Broadcom patents.

Broadcom has called on the ITC to launch an investigation into Qualcomm's imports and to issue an exclusion order to prevent these products from being imported into the US.

The company is also seeking a cease and desist order to bar further sales of allegedly-infringing Qualcomm products that have already been imported.

Broadcom expects that the ITC investigation will start in late June and that the case will be tried early next year.

In a statement, Broadcom president and CEO Scott McGregor said: "We believe that Qualcomm's current and next generation cellular baseband and radio frequency product lines infringe a number of our patents."
