SMIC sues TSMC over unfair competition

SMIC China's leading foundry, has filed a law suit against Taiwan's TSMC the world's leading foundry, over alleged unfair competition.

According to a Reuter's report, the High Court in Beijing accepted on Thursday SMIC's filing in which it claimed TSMC had intentionally disseminated untrue and misleading statements to damage SMIC's reputation and goodwill.

SMIC, run by Taiwan-born tycoon Richard Chang, said it was seeking a public apology and compensation from TSMC, among other things.

A TSMC official said the company could not comment on the suit before obtaining a statement from the Beijing court.

"SMIC will vigorously pursue the complaint in order for the Beijing High Court, upon full consideration of all evidence, to grant a fair judgement and support SMIC's claim for defending its legal rights," it said.

This legal action is the latest in a row between the two chip makers.

In September, SMIC denied an accusation by TSMC that it had violated a patent deal and filed a counter-complaint against the Taiwan company.

TSMC has filed a series of suits in the past several years alleging that SMIC had been systematically stealing its intellectual property by aggressively hiring former TSMC employees.

The two companies settled a previous dispute at the beginning of 2005, with SMIC agreeing to pay $175 million over six years to settle patent and trade-secret litigation.
